Overview

A law enacted at the end of the 2023 Minnesota legislative session legalized adult–use cannabis in Minnesota and established a regulatory framework over the cannabis industry. Click here to read the full bill.

The law legalized the possession, use, manufacturing, and sale of certain cannabis products within the state. It established the Office of Cannabis Management (OCM), which is charged with, among other things, enforcing an organized system of regulation for the cannabis industry and the hemp consumer industry. The law also:

Establishes labor standards for the use of cannabis and hemp products by employees and testing of employees.
Establishes expungement procedures for certain individuals previously convicted of a crime related to cannabis.

Possession, use, and home growth became legal under this new law on August 1, 2023, and legal sales are expected to begin in Summer/Fall of 2025.

City of Chanhassen Cannabis Regulations

On August 11, 2025, the City of Chanhassen adopted an ordinance amendment regulating local cannabis retail business registration. This ordinance defers the local cannabis retail licensing authority for the portion of the city within Hennepin County to Hennepin County. Read adopted ordinance #749 for more details.

On April 14, 2025, the Office of Cannabis Management (OCM) adopted rules completing the regulatory framework for Minnesota’s new cannabis industry, including licensing (license types, forms, procedures, required disclosures, felony disqualifications, and limits on licenses held). On March 10, 2025, the City of Chanhassen adopted an ordinance regulating the zoning for cannabis businesses. This ordinance details performance standards for cannabis retail and industrial uses in addition to designating the zoning districts that allow cannabis businesses as a permitted use. On December 9, 2024, the City of Chanhassen adopted an ordinance regulating local cannabis retail business registration, temporary cannabis event licensing, and lower-potency hemp edible sales. This ordinance also defers the local cannabis retail licensing authority to Carver County. Read adopted ordinance #736 for more details.

The City of Chanhassen prohibits the operation of cannabis retail businesses within 500 feet of a school or a residential treatment facility in the Highway Business District, Central Business District, or General Business District. The buffer distance is measured between the perimeter of the relevant structures or building units.

Cannabis Licenses and Registration

The City of Chanhassen has deferred all local cannabis retail licensing to Carver and Hennepin Counties. Please contact the Carver County Elections and Licensing (952-361-1903) or the Hennepin County Environmental Health Division with any questions. As a part of the state's Office of Cannabis Management licensing process, applicants will be required to register with the applicable county for the following license types:

Cannabis microbusiness with a retail operations endorsement.
Cannabis mezzobusiness with a retail operations endorsement.
Cannabis retailer, medical cannabis retailer, or lower-potency hemp edible retailer that:
- Has a valid license issued by the OCM.
- Has paid the registration fee.
- Is found to be in compliance with the requirements of the applicable state laws through. a preliminary compliance check performed by the city.
- Is current on all property taxes and assessments at the location where the retail. establishment is located.

The city will review the application to determine the following:

If the proposed business complies with local zoning ordinance.
If the proposed business complies with the state fire and building code, if applicable.
Identify concerns about the proposed location of a cannabis business, share public information about the applicant, etc.

The county will review the application to determine the following:

Complete administrative paperwork and submit to the OCM.
Complete any follow up inspections.
