GENERAL BUSINESS
The City Council approved a series of agreements related to the Avienda Apartments project, a 412-unit multifamily development within the Avienda mixed-use district that has already received all required zoning entitlements. Monday’s special meeting represented the final step following prior Council actions approving the project’s plat and development contract.
Community Development Director Eric Maass presented the agreements, which included provisions for parking deferment, public pedestrian trail access, private roadway and sidewalk encroachments, and several temporary construction and drainage easements tied to stormwater and regional pond improvements. The agreements also outlined ongoing maintenance responsibilities and established the city’s role as a third-party beneficiary where applicable.
Council discussion largely centered on parking, particularly the project’s approved deferment of 93 spaces—allowing 633 to be built initially instead of the 726 required by code. Several council members raised concerns about visitor parking, potential future demand and the process for determining when additional spaces might be required. Staff clarified that the deferment aligns with city code and past practice, that parking will be monitored over time and that the city retains full authority to require additional parking construction if warranted.
Council members noted that while the agreements were consistent with prior approvals, they shared concerns about the potential difficulty of adding parking later—particularly if it requires relocating amenities such as the dog park or trail. They emphasized the importance of designing the trail layout to minimize future disruption should additional parking be required.
Following discussion, the City Council voted 4-0 to approve the agreements with minor modifications as may be approved by the City Attorney, acknowledging ongoing concern about parking adequacy and the need for careful monitoring as the project advances.
